Terms of Service

Effective date: 28 October 2026

Welcome to Jacque Visagie | MEN. GREATER LIVES. These Terms of Service (“Terms”) govern jacquevisagie.com and the coaching, content, events, programmes and related services provided by Kaizen Wellness International LLC, a limited liability company registered in Delaware, United States (“Company”, “we”, “our” or “us”). “Jacque Visagie” and “MEN. GREATER LIVES” are the brands under which the Company provides these services. Questions may be sent to [email protected].

Please read these Terms and our Privacy Policy before purchasing. By expressly accepting the Terms at checkout, entering into a coaching agreement or accessing paid services, you agree to the provisions applicable to you. If you purchase for an organisation, you confirm your authority to bind it.

1. Services covered

Our services may include paid Exploration Calls; private one-to-one, group, executive and high-performance coaching; structured or bespoke programmes including RISE; live or scheduled video and audio calls; webinars and workshops; in-person events; memberships or communities; assessments, questionnaires and accountability; and digital educational materials such as prerecorded videos, audios, written lessons, courses, articles, downloads and workbooks. These Terms cover these formats when offered by the Company, but do not mean every format is available or included in a particular purchase. The relevant offer, invoice or written agreement specifies what you are buying, its duration, inclusions and applicable conditions.

2. Eligibility and appropriate use

Our paid personal coaching services are intended for adults aged 18 or older unless a separate, lawful written arrangement is made. You agree to provide accurate booking and contact details, use the service lawfully, respect other participants and our team, and refrain from harassment, threatening conduct, unauthorised sharing, impersonation or disruption of calls and community spaces. We may reasonably refuse or discontinue services where continued participation would be inappropriate or unsafe, subject to any refund or other remedy required by law and the particular agreement.

3. Coaching scope and professional boundaries

Coaching supports reflection, goals, personal leadership, behaviour, performance, decision-making and development. It is not a substitute for medical care, psychotherapy, psychological or psychiatric diagnosis or treatment, legal counsel, financial or investment advice, or crisis intervention. Nothing on the website or in a programme creates a clinician-patient relationship. If you are in immediate danger or experiencing a mental health emergency, contact appropriate local emergency or qualified professional services. You are responsible for decisions and actions you make, and we do not guarantee particular life, work, relationship, health, earnings or business outcomes.

4. Pricing, purchase and payment

Prices, currencies, taxes where applicable, payment frequency and inclusions are displayed in the specific offer or checkout before you purchase. Payments may be handled through Kajabi and Stripe or another disclosed payment service provider. You authorise charges you expressly approve, including instalments or recurring charges only when clearly disclosed and selected. A one-time purchase does not create a recurring subscription. For an ongoing subscription, the checkout must state renewal and cancellation arrangements. Please retain your purchase confirmation and contact us promptly about any billing error.

5. Exploration Calls and appointment booking

An Exploration Call is currently offered as a paid 30-minute private online session at the price shown at checkout, currently R695 for the South African offer. After successful payment, you receive an Acuity Scheduling link on the confirmation page and by email. Payment does not reserve a particular appointment time. Your appointment is reserved when you complete the scheduler and receive its confirmation. Calls currently take place via WhatsApp Video; you must provide a reachable WhatsApp number with country code and be available in a suitable private location with reliable connectivity. The fee covers the specified call, not a coaching package or platform membership.

6. Scheduling, rescheduling, missed appointments and service changes

Available times, time zones and appointment procedures are shown in the booking system. If you need to reschedule, use the booking confirmation’s instructions or email us as early as possible. Specific cancellation windows, expiry periods, missed-session rules or package rescheduling limits will be disclosed in the applicable booking confirmation, checkout or separate coaching agreement before they are enforced. We may need to reschedule because of illness, emergency or technical problems and will offer an appropriate replacement appointment or other lawful remedy. We will not impose a cancellation charge or forfeiture that is unlawful or was not properly disclosed.

7. Refunds and statutory consumer rights

Any service-specific refund policy will be disclosed at purchase. Unless a separate valid policy provides more favourable terms, refund requests are considered with regard to whether services or digital content have already been delivered, the circumstances of cancellation and applicable law. Where we cancel a service and cannot provide an appropriate alternative, we will provide a refund or other remedy required by law. Nothing in these Terms excludes mandatory cooling-off rights, statutory remedies, rights relating to defective or misdescribed services, or other non-waivable consumer protections. Contact [email protected] for assistance.

8. Digital content and programme access

Digital courses, prerecorded videos and audio, replays, downloads, frameworks and other content are licensed for the personal use of the purchaser, or for the expressly agreed authorised participants in an organisational arrangement. The access period, release schedule, membership terms and any replay availability are those stated in the offer; lifetime access is not implied. We may make reasonable updates, corrections or substitutions that do not materially deprive you of what you purchased. Your access may require a supported device, browser, internet connection or third-party platform.

9. Accounts and third-party technology

Some purchases may create a customer record or require login credentials, even if no course or membership is included. Keep any login details secure. Services may use Kajabi, Stripe, Acuity Scheduling, WhatsApp and other disclosed meeting, email, hosting or delivery providers. Each provider may have its own terms and privacy practices. We are responsible for our own obligations but cannot guarantee uninterrupted availability of external services. We will take reasonable steps to address disruptions affecting scheduled services.

10. Live sessions, recordings and participant contributions

Private one-to-one calls are not routinely recorded for publication. If we propose to record a private session, we will explain the purpose and obtain appropriate prior consent. Group calls, webinars, training events and programme replays may be recorded where this is disclosed in advance; participation options and recording arrangements will be explained for the relevant event. We will not publicly use identifiable client stories, testimonials, images, voices, or private coaching disclosures for marketing without an appropriate lawful basis and any required consent. Other participants in group settings must respect confidentiality, though we cannot guarantee their conduct.

11. Confidentiality and communications

We treat coaching information discreetly and restrict its use to service delivery, administration and other lawful purposes described in our Privacy Policy. Confidentiality may be subject to legal obligations, court orders, safeguarding concerns or disclosures you authorise. Email, messaging, video calls and community platforms cannot be promised to be absolutely secure. Please avoid sending unnecessary highly sensitive information through ordinary messaging channels. Our services and support inbox are not monitored as emergency response channels.

12. Client responsibilities and participation

Coaching results depend on circumstances outside our control, including your participation and independent decisions. You agree to respect meeting times, communicate relevant access difficulties, exercise your own judgement, seek appropriately qualified advice where needed and maintain reasonable conduct in group spaces. Any physical activity, nutrition or health discussion is general education unless explicitly provided under a separate suitable professional arrangement.

13. Intellectual property and licence

Website content, original text, brands, videos, audios, recordings, presentations, programmes, assessments, workbooks, methods and materials are owned by the Company or its respective licensors, unless otherwise stated. Your purchase grants a limited, non-exclusive, non-transferable licence for the authorised personal or organisational use specified in your offer. You may not reproduce, resell, distribute, publicly post, commercially exploit, train AI systems on, or share paid material or access credentials without prior written permission, except where the law permits. Your own original content remains yours, subject to licences necessary to deliver the service.

14. Website information and external links

Our articles and free educational materials are provided for general information and do not create an individual coaching engagement. References or links to third-party websites, tools or resources are provided for convenience and do not necessarily constitute an endorsement. External sites control their own content, availability and policies.

15. Service availability, disclaimers and liability

We undertake to provide paid services with reasonable care and skill and in accordance with any mandatory legal standards. To the extent permitted by applicable law, we do not guarantee uninterrupted website access or specific personal or commercial results and are not responsible for losses arising solely from decisions made independently of our coaching. Any limitation of liability applies only to the extent legally permitted and does not exclude liability for fraud, intentional misconduct, gross negligence where exclusion is prohibited, or rights and remedies that cannot lawfully be limited. Any liability provisions in a separately signed agreement must also comply with applicable law.

16. Programme-specific terms and organisations

Packages, RISE, workshops, corporate services and future programmes may require additional terms addressing fees, instalments, participation, delivery schedules, confidentiality, recording, cancellation and access. Those specific, properly disclosed terms supplement these Terms; in case of inconsistency, the more specific written service agreement applies to that service unless law requires otherwise. No ongoing support or direct messaging availability is included unless the offer expressly says so.

17. Suspension and termination

We may suspend access where reasonably necessary for security, non-payment, material breach or misconduct, after appropriate notice where feasible. You may discontinue participation at any time, subject to the terms and legally applicable financial consequences of your purchase. Clauses regarding payment obligations already incurred, confidentiality, intellectual property and lawful dispute resolution may continue where appropriate after termination.

18. Privacy, communications and marketing

Our Privacy Policy explains how personal information is used. We may send necessary payment, scheduling, access and service emails. Optional newsletters and promotional communications are handled separately, with legally required consent or unsubscribe choices. Consent to marketing is not a condition of purchasing an Exploration Call.

19. Governing law and disputes

The Company is registered in Delaware, United States. The law applicable to a particular dispute will depend on the transaction, relevant consumer-protection rules and any valid, expressly agreed service-specific jurisdiction provision. Delaware registration does not displace mandatory protections available to consumers in other jurisdictions, including South Africa. Please first contact us at [email protected] so we can attempt a fair resolution. Nothing here removes a right to approach an appropriate regulator or court.

20. Changes and contact

We may update these Terms by publishing a revised version with a new effective date. Changes do not retrospectively alter an existing paid engagement where doing so would be unlawful or contrary to its agreed terms. For coaching, billing, privacy or other questions, email [email protected].
